ERISA Plans as Primary Targets – Protecting Nest Eggs from Cyber Crime

Our speaker is a “seasoned cyber smoke jumper” who has handled hundreds of breach events cases for the US intelligence community and commercial organizations. We will also be joined by an ERISA attorney who specializes in advising companies that offer ERISA plans on the legal requirements and best practices for complying with the DOL’s cybersecurity requirements, and other laws affecting employee benefit plans.
This session is designed for retirement plan sponsors and their advisors. The session will focus on the legal requirements for complying with the current DOL guidance, and also provide a practical summary of the technical threats these plans can face including ransomware attacks, intrusions, email compromises, invoice scams and other major incidents that can create a groundswell of financial losses and wipeout the hard earned lifetime security of retirement for thousands of individuals. The session will also give attendees an idea of what it’s really like to be in the boardroom during a cyber event, help identify systemic and process vulnerabilities, and get a leash on concrete tactics they can take back to their organizations to create a holistic cyber strategy in support of its enterprise risk management objectives. The session will include an interactive Q&A.
Speakers
Bryan Hurd, Managing Director, Chief of Office, Seattle, Aon Cyber Solutions Global (Stroz Friedberg)
Mr. Bryan E. Hurd is a globally recognized computer forensics leader and expert in cyber intelligence, investigations, and operations to fight espionage, terrorism, organized crime groups and criminals who target vulnerable populations. Bryan was the founder of the Cyber Counterintelligence program for the US Navy at the Naval Criminal Investigative Service (NCIS) in 1994 and has gone on to hold executive positions as first Director of Intelligence for the Digital Crimes Unit within the Microsoft Cyber Crime Center, founding the computer forensics program at EDS (Now HP) and was the executive in charge of innovation for the entire US watchlisting system as the Chief of Operations, Director of Terrorist Identities at the National Counterterrorism Center (NCTC). Bryan now leads some of the most significant breach responses in the US today as a senior leader at Aon Cyber Solutions (Stroz Friedberg), and serves on company boards.

Nick focuses his practice on advising corporate counsel, company executives, and HR professionals in all aspects of the employee benefit plans sponsored by their organizations. He advises retirement plan fiduciaries on their responsibilities under ERISA and regularly meets with investment and administrative committees to ensure they are fulfilling these responsibilities. Nick has worked extensively with for profit and non-profit organizations in many industries to structure benefit plans, and amend them, to comply with various federal laws.
Nick also advises trustees, plan administrators and service providers of multiemployer trust funds and other collectively bargained plans on issues such as compliance with the Affordable Care Act, plan design, withdrawal liability, trust administration, plan investments, fiduciary duties, QDROs, QMCSOs, and general compliance with ERISA, the IRC, federal labor law, and other laws affecting multiemployer plans.
Nick has represented numerous organizations in controversies before the IRS, DOL, and PBGC. He has negotiated the resolution of compliance issues for retirement plans through IRS remedial programs such as VCP, Audit CAP, and SCP. Nick has considerable experience in the DOL’s remedial programs such as the DFVC and VFC programs.
